Terms of Use Agreement

Our online store welcomes you and informs you that below are the terms and conditions governing your use of this store and all the legal consequences arising from your use of the store’s services via the internet through this electronic platform. The use of this store by any person, whether as a consumer of a service or product of the store or otherwise, constitutes their consent and acceptance in full legal capacity recognized by Sharia, system, and law to all the provisions and terms of this agreement, confirming your commitment to its regulations and what is mentioned herein. This agreement applies to all types of dealings between the consumer and the store. This agreement becomes effective and binding as soon as you agree to it and begin registration in the store according to Article 10 of the Saudi Electronic Transactions Law.

Article 1 – Introduction and Definitions:

The above preamble is an integral part of this agreement, and below you will find the meanings and definitions of the main terms used in this agreement:

(Store): This term includes all forms of the store on the internet, whether it is an electronic application, a website on the internet, or a commercial shop.
(Consumer): The person who deals in e-commerce intending to obtain the products or services provided by the store via its electronic platform.
(Agreement): This phrase refers to the terms and conditions of this agreement, which govern and organize the relationship between the parties to this agreement.

Article 2 – Legal Capacity of the Consumer:

The consumer acknowledges that they have the legal capacity recognized by Sharia and system to deal with the store, or that their age is not less than eighteen years.
The consumer agrees that in case of violating this article, they bear the consequences of this violation before others.

Article 3 – Nature of Commitment:

The store’s commitment towards the consumers is to provide the (service or product).
The store may provide additional services such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.

Article 4 – Usage Controls:

The consumer commits to using the electronic platform of the store in accordance with public decency and the applicable laws in the Kingdom of Saudi Arabia.
The consumer commits when purchasing a service or product from this store not to use the service or product in a manner contrary to public decency or the applicable laws in the Kingdom of Saudi Arabia.

Article 5 – Accounts and Registration Obligations:

Upon applying to join as a member of this store as a user, you are committed to disclosing specific information and choosing a username and secret password to use when accessing the store’s services. By doing so, you agree to:

Be responsible for maintaining the confidentiality of your account information and password and agree to immediately inform the store of any unauthorized use of your account or any breach of your confidential information.
The store will not be responsible under any circumstances for any loss, direct or indirect, material or moral, resulting from the disclosure of the consumer’s username or password.
You commit to using your account or membership yourself, and you are fully responsible for it; if someone else uses it, this is evidence that you have authorized them to use the store under your name and account.
You commit to using the store with seriousness and honesty.
You commit to providing true, correct, updated, complete, and legal information about yourself as required during registration and to update your data in case of any changes.
Our store commits to handling your personal information and contact details with complete confidentiality.
If it is found that you have disclosed false, incorrect, outdated, incomplete, illegal, or contradictory information to this agreement, the store has the right to suspend, freeze, or cancel your membership or your store and account on the platform without prejudice to the store’s other rights and legal means to recover its rights and protect other consumers.
In case of non-compliance with any of the above, the store management has the right to suspend or cancel your store or membership or block your access to the store services again.

Article 6 – Electronic Communications and Official Communication Means:

The parties to this agreement agree that communication will be conducted via the registered email on the platform.
The consumer agrees that all agreements, advertisements, data, and other communications provided electronically shall have the same effect as their written counterparts and shall constitute valid evidence in meeting regulatory and legal requirements.
The consumer agrees that the store management may communicate and notify them of any provisions related to this agreement or their dealings by broadcasting general messages to all consumers or to specific users of the store.

Article 7 – Amendments to the Terms of Use and Fees:

If any provision or clause of this agreement is canceled or becomes invalid, this does not invalidate the remaining provisions, clauses, rules, and terms contained in this agreement, which remain effective until further notice from the store management.
This agreement — which may be amended from time to time as appropriate — constitutes the mechanism of work, understanding, and agreement between the consumer and the store.
The store may impose fees on some consumers depending on the offers, products, or services they request or as required by the state regarding fees or taxes related to the nature of the product or service.
The store reserves the right to add, increase, decrease, or deduct any fees or expenses under the terms and conditions of the Terms of Use agreement on any consumers regardless of the reason for their registration.

Article 8 – Payment and Settlement Services for Stores on the Platform:

The store provides through its partners a payment and settlement system within the store, which can be done entirely online through the payment options available on the store or through any payment method the store provides from time to time.
The store commits to setting the price of the service or product it offers in its store according to the commonly recognized market value.
The store commits to providing invoices, receipts, and acknowledgments for all amounts and profits generated in its store and to providing the consumer with a purchase invoice for a service or product.
The store commits to applying recognized accounting standards in its e-store, in implementation of this agreement and for legal, economic, commercial, and regulatory interests.

Article 9 – Intellectual Property:

The intellectual property rights of the store are fully owned by the store, whether owned before or after establishing this electronic platform.
The consumer respects the intellectual property rights of the store, including the store’s name itself, the words, logos, and other symbols related to the store or displayed on it, as all rights associated with the store’s name are fully owned intellectual property rights.

Article 10 – Store Liability:

The store commits to conducting its commercial work through this electronic platform in a regulated manner and in accordance with the laws and regulations applied in the Kingdom of Saudi Arabia and according to the provisions of this agreement.
The store does not bear any claims arising from errors or negligence, whether directly, indirectly, incidentally, or by the consumer or a third party such as shipping companies.
The store and its personnel, owners, and representatives commit that the product or service is sound, legal, authorized under the laws and regulations of the Kingdom of Saudi Arabia, and used for legitimate purposes.

Article 11 – Access or Membership Restriction:

The store may suspend or cancel the consumer’s membership or restrict their access to the platform’s services at any time without prior notice and for any reason, without specification.

Article 12 – Governing Law:

This Terms of Use agreement is governed and drafted in accordance with the laws, regulations, and legislations applied and effective in the Kingdom of Saudi Arabia and is fully subject to the competent authorities in the Kingdom of Saudi Arabia.

Article 13 – General Provisions:

If any provision or clause in this Terms of Use agreement is canceled or becomes invalid, this does not invalidate the remaining provisions, clauses, and terms contained in this agreement, which remain effective until further notice from the store management.

This Terms of Use agreement — which may be amended from time to time as appropriate — constitutes the terms of use and mechanism of work, understanding, agreement, and contract between the store and the consumer. Both parties agree to the following:

Arabic is the official language used in interpreting this agreement or when translated into another language.
All prices displayed on the store’s services or products may be amended from time to time.
Promotional or marketing offers placed by the store are temporary, and the store reserves the right to amend or stop these promotional or marketing offers at any time.
The parties to this agreement commit to dealing with each other in a manner consistent with Sharia, applicable laws, and related regulations governing the nature of dealings between the store and the consumer.
This Terms of Use agreement may only be canceled by a decision issued by the store management.
